推定無罪は"Innocent Until Proven Guilty"と"Presumption of Innocence"どっち?

「推定無罪」って英語で何？

推定無罪って英語でなんと言うのだろうかと気になって調べていたんです。一応辞書には、

the presumption of innocence

とは載っているんですけど、こんな表現、海外ドラマで聞いたこと無いんですね。弁護士モノ、裁判モノのドラマは結構見ているはずなんですけど、決まって海外ドラマの登場人物はこう言うんです：

海外ドラマでは「Innocent Until Proven Guilty」一択

どれもこれも「innocent until proven guilty」ばかり。直訳すれば「有罪が証明されるまでは無罪」。そのまんまですね。

というか、よく見れば、presumption of innocenceって訳すと「無罪の推定」じゃないですか（笑）　日本語の推定無罪と順番逆じゃん。ミルクチョコとチョコミルクくらいの違いがあるのでは・・・

そこで、困った時のWikipediaです：

無罪の推定は法原理だ、人は有罪が証明されるまで無罪と見做さられる。

The presumption of innocence is the legal principle that one is considered innocent unless proven guilty.

なんとWikipediaにはpresumption of innocenceの方が載っていました。どうも、法原理ではこちらの言い方が正式みたい。

そして、スクロールしていくと・・・

「無罪の推定」は、検察は合理的疑い（または、刑事司法制度に依存した他のあるレベルの証明）を超えて、犯罪の各要素を証明する義務があることを強調する役目を果たす。これはしばしば、フレーズ「有罪が証明されるまで無罪」で表現される、これは英国の法廷弁護士ウィリアム・ガロウによって名付けられた。

“Presumption of innocence” serves to emphasize that the prosecution has the obligation to prove each element of the offense beyond a reasonable doubt (or some other level of proof depending on the criminal justice system) and that the accused bears no burden of proof. とありました。つまり、presumption of innocenceって言い方が分かりづらいから、平易に言い換えたinnocent until proven guiltyが流通するようになった感じかな。

英語での「推定無罪」まとめ

だから、まとめると

• presumption of innocence・・・法律専門家
• innocent until proven guilty・・・一般大衆

って分類かな。でも、海外ドラマのキャラ達だって弁護士や検察なんだから、一応は法律の専門家。なのに「innocent until proven guilty」の方を使うってことは・・・脚本家の知識不足？　でも、本物の法律エキスパートが出来上がった脚本チェックしてるんだろうし・・・。でも、視聴者はpresumption of innocenceという耳慣れない表現を聞くより分かりやすいinnocent until proven guiltyを好むだろうから・・・。と考えていたら堂々巡り（go around in circles）してしまいました（笑）

（追記）『殺人者への道』の例

海外ドラマでは「innocent until proven guilty」一択というか、そもそも「presumption of innocence」という言い回しが出てこないんですが、後日「presumption of innocence」が頻出する番組を見つけました。それが、ドキュメンタリー『殺人者への道』。これは現実の殺人事件を扱っているため、著名な法律家や実際の法廷シーンが出てくるんですが、その中で「presumption of innocence」が使われます。ということで、やはりpresumption of innocenceは専門的な用語というのは合ってそうです。

「推定無罪」：Googleの件数で勝負

そこで、頼みの綱Googleさんに判定してもらいましょう。検索結果の件数で勝負です。

• innocent until proven guilty・・・About 21,600,000 results

３倍の差で「innocent until proven guilty」の圧勝。だから、「推定無罪」を専門的でない場面で使う時は「innocent until proven guilty」で良さそうです。

日本語「推定無罪」と英語「presumption of innocence」の語順

ちなみに、「推定無罪」と「presumption of innocence」の順が逆になっている原因は、日本語Wikipediaの記事に載ってました：

「無罪の推定」という表現が本来の趣旨に忠実であり（presumption of innocence）、刑事訴訟法学ではこちらの表現が使われるが、近時、マスコミその他により、推定無罪と呼ばれるようになった。[要出典]

なんと、日本語の「推定無罪」が間違っているのでした（笑）　確かに、推定無罪って、考えてみると意味がよく分からないかな。まあ、要出典ですので、信じるかどうかはご自身で判断を。

最後に、Google Books Ngram Viewerで書籍の情報を調査すると・・・え？　逆にこっちはpresumption of innocenceが２倍の差。

うーん、なんだかよくわかりませんね（笑）　結論がなくて申し訳ないけど、自分が使うんだったら海外ドラマで使われているinnocent until proven guiltyかなあ。実際、CNNなんかのニュースでも使われているしね。
